All pools and spas must be fenced and the fences certified as conforming to the new regulations. These new rules apply to all pools and spas as of the 1.12.2010
When purchasing a property that has a pool, the vendor is responsible for the pool fence safety certification.
If the pool is not certified then a Form 36 must be in place.
We can organise for the building and pool fence safety inspections to be carried out at the same time.
The pool fence safety certificate will be issued when the fence conformed with the new regulations and the certificate is current for 1 year for Shared Pools and 2 years for all regulated pools
If the pool fence is non conforming with the regulations then the Form 26 must be issued within 2 business days and be in the vendors name and sent to the vendor.
The original inspector must be contacted to re inspect the pool within . If a re inspection has not been completed then the inspector must give notice to the local government that the pool fence is non compliant.
It is an offense to have the re inspection carried out by another pool safety inspector or local government within this period, or to ask another inspector other than the original inspector to inspect the pool for the purposes of giving a safety certificate for the pool. Fines are applicable.
Pro-Check Building Services offers a special fee for service when they carry out the building and pool fence safety inspections at the same time for those clients with a Form 36 in place.
We will organise other inspections for you such as Pest, Electrical and a pool and pump inspection by professionals. These will normally be organised to take place at the same time.
Resuscitation sign
A Resuscitation sign must be attached to the pool barrier or displayed near the pool so that the sign is conspicuous and easily visible to anyone near the pool and must show 30 compressions and infant resuscitation.
The sign must be at least 300mm x 300mm in size and be made of durable and weatherproof material.
Include a statement that is prominent on the sign explaining to anyone reading the sign how to act in an emergency, including an example, telephoning for an ambulance, staying with the injured person, calling for help and providing first aid.

It is the owners responsibility to provide compliant fencing and maintain it in a manner that is safe for users.

1. Compliant resuscitation sign prominently displayed at the pool fence.
2. Are all spaces less than 100mm?
3. Is the barrier 1200mm high?
4. Are there Objects with in a 1200mm clear zone from the bottom?
5. Is there a 900mm clear no climb zone above the barrier.
6. Are there any footholds?
7. Is the gate self closing and latching?
8. Does the gate open outwards?
9. Is the release mechanism shielded?
10. Are there any sharp edges or hazards?
Research has shown that a child is at greater risk of drowning in
the first six months of using a new pool or moving into a property that
has a pool.
Pool fencing has been proven to help reduce the drowning rates but due
to the determination and fascination of children with water there is no
substitute for vigilant adult supervision at all times when you have a
pool.
Swimming
pool safety laws are in place to try to reduce the number of drownings and serious immersion injuries in swimming pools involving children less than 5 years of age.
